COLLABORATIVE LAW

Collaborative law is an exciting option for divorcing couples. It is an out of court dispute resolution method that utilizes a team approach. Each spouse hires a collaborative attorney to represent them and jointly they retain other members of the team necessary for their particular divorce. Team members will be tailored to your particular case and could include a coach facilitator, financial professional, child specialist, appraiser or valuation expert.

Collaborative law is similar to mediation in that the parties fully participate in the resolution and settlement of all of the terms of their divorce but collaborative law offers the benefit of your own advocate fully participating in the resolution. Your own advocate is with you throughout the entire process.

As your collaborative attorney, Susan will work for you but she will use client focused strategies and reasoning to create a positive atmosphere for settlement. The whole team will sign a contract called a Collaborative Process Agreement which will define the collaborative process and the commitment to resolve the separation and divorce without litigation in court. You and your spouse will commit to a full and honest exchange of information and to work cooperatively in the settlement process. You will have a series of respectful face to face or virtual team meetings. This process avoids the expenses of trial and the emotional harm a lengthy, public process could have on you and your children. The collaborative law process empowers the divorcing couple to develop terms that work for them and their family.
